Crowdfunding Prize Draw - T&Cs

TERMS AND CONDITIONS:

1. By entering this prize draw ("Draw"), you agree to be bound by these terms and conditions.

2. The promoter is The Real Mary King's Close, a brand and visitor attraction operated by Continuum Group Limited, a company registered in England and Wales (Company No. 01969044) with registered office at Continuum Group Limited, Saint Edmunds House, Margaret Street, York, YO10 4UX, England, United Kingdom.

3. Any proceeds generated from paid entries to the Draw will be used to support the ongoing preservation of the Close and all its spaces, helping to preserve their fabric, uncover its stories, and ensure this hidden part of Edinburgh's history can be shared for generations to come.

Eligibility

4. The prize draw is open to residents of the United Kingdom aged 18 or over only. The Real Mary King's Close disclaims any liability for entries that are made in violation of any applicable laws or regulations. Entrants from jurisdictions where the Draw is prohibited acknowledge that their entry may be considered void and are not eligible for any prizes. It is your responsibility to ensure that your participation is lawful, and The Real Mary King's Close reserves the right to disqualify any entries deemed to be in violation of any laws or regulations, and will not be liable in any way if any entrant enters the prize draw unlawfully.

5. Anyone entering the prize draw accepts that in the event that they win a prize they are responsible for any and all expenses which they may incur which are incidental or connected to the prize including without limitation their own travel to and from experiences.

6. Entrants must be aged 18 or over.

7. Entrant(s) must not be an employee or supplier (or a family member of an employee or a supplier) of The Real Mary King's Close, Crowdfunder, nor any of those parties' associated companies or entities.

Entry Requirements and Entry Period

8. Entrants may enter the Draw either by free postal entry, or (at the entrants discretion) by making a payment to the Crowdfunder campaign.

9. Paid entry to the prize draw is available via Crowdfunder (https://www.crowdfunder.co.uk/p/win-real-mary-kings-close).

10. For free entry, postal entrants may enter the promotion:

a. By mailing their full name and a contact telephone number (including area code if providing a landline number) or other method of contact (as applicable) to the following postal address: The Real Mary King's Close, 2 Warriston's Close, High Street, Edinburgh, EH1 1PG

b. Maximum one entry per envelope. Multiple free entries are permitted, provided each entry is submitted in a separate envelope.

11. The prize draw opens at 10:30 (GMT) on Thursday 12th March ('Opening Date') and closes at 21:00 (BST) on Monday 30th March ('Closing Date'). Any entries received after the Entry Period will not be accepted. Personal and hand delivered entries will not be accepted.

12. The Real Mary King's Close is not responsible for any delays in delivery or receipt of postal entries.

The Draw and The Prize Winners

 

13. A random draw of all valid entries will take place within 7 days of the Closing Date as stated above to select the one (1) main winner and ten (10) runners up. The winners will be notified by email or telephone, and MUST respond within 7 days of the date of contact. If any selected winner does not meet any or all of the entry conditions or refuses the offer or fails to respond within 7 days, the Promoter may in its discretion select another entrant at random from the remaining eligible entries as soon as practicable as a replacement and to become a winner.

14. Once the Closing Date has passed, each individual valid entry will be entered into the draw.

15. Multiple entries per person are permitted, but only one Prize per person will be given. For the avoidance of doubt, each winning entrant will only be entitled to either the one (1) main prize (if overall winner) or one of the ten (10) runner up prizes.

16. Entries from agents, third parties, syndicated entries or those made using methods such as a computer macro, script or the use of automated devices are not permitted in any way.

17. Winners will be announced on The Real Mary King's Close social media channels within 14 days of the draw taking place.

18. The promoter's decision as to the Prize winners is final, subject to compliance with applicable law. Unsuccessful entrants may not be contacted.

The Prizes

19. One (1) winner will receive an exclusive overnight experience for two people at Real Mary King's Close, Edinburgh. This main prize includes: Private, after hours access to Real Mary King's Close; A guided immersive experience at Real Mary King's Close, including full character interactions delivered by professional costumed performers; A special after-hours dinner for two (2) people; The opportunity to spend the night inside Real Mary King's Close, subject to the historic nature and facilities of the site, or at the winner's discretion, overnight accommodation for two (2) people in a partnered hotel located adjacent to Real Mary King's Close, with access to shower and bathroom facilities. The winner may move between the partnered hotel and Real Mary King's Close during the overnight period; Honoured guest access for two (2) people to all of The Real Mary King's Close specialised tours running during 2026, comprising: Contagion & Carnage: The Plague Tour (April 2026), A Dram of History (May 2026), Pride History Tour (June 2026), Dr Arnott's Sampling Sensation (available all year), Myths and Legends Tour (September 2026), Lantern Led Tour (October 2026), and Victorian Christmas Experience (December 2026). Access to each specialised tour is subject to availability and the Promoter's published schedule. The Promoter reserves the right to amend the specialised tour programme (including dates, content, or availability) and will use reasonable efforts to offer the winner a suitable alternative where a tour is cancelled or materially altered. Ten (10) runner-up winners will each receive two (2) standard entry tickets to Real Mary King's Close.

20. The prizes are non-exchangeable, non-transferable and are not redeemable for cash or other prizes.

21. All prizes may not be sold or transferred to another person or redeemed for cash.

22. For UK based winners, prizes will be redeemable not before 30th April 2026.

23. The receipt by the winning entrant of any of the Prizes is conditional upon the winning entrant's compliance with these rules. Winning entrants may be required to provide a written acknowledgement of these rules and other terms and conditions, consents or releases relating to the Prizes.

24. The main Prize involves an overnight experience in a historic underground environment. The winner and their guest must be physically and medically fit to participate and must comply with all reasonable health and safety instructions provided by the Promoter. The Promoter reserves the right, in its reasonable discretion, to refuse participation, modify the experience or require the winner or their guest to leave the site if it considers that participation may pose a risk to the health or safety of any person. Where the main Prize cannot be delivered safely for any reason, the Promoter reserves the right to offer an alternative prize of equal or greater value.

General

25. The Real Mary King's Close shall not be liable for any failure or delay in performing its obligations to the winner(s) if such delay or failure is caused by circumstances beyond its reasonable control.

26. The main Prize must be taken on a date agreed between the Promoter and the winner, subject to availability. The Promoter may require the winner to provide at least three preferred dates. The Promoter will use reasonable efforts to accommodate the winner's preferred dates, but availability cannot be guaranteed. If the winner is unable to attend on any of the dates reasonably offered by the Promoter within six (6) months of notification, the Promoter reserves the right to offer an alternative prize of equal or greater value.

27. The Real Mary King's Close reserves the right to make any reasonable amendments to these Terms and Conditions at any stage. In this event, a notice will be posted on (https://www.crowdfunder.co.uk/p/win-real-mary-kings-close). The Real Mary King's Close also reserves the right to hold void, suspend, cancel, or amend the prize draw where it becomes necessary to do so (including without limitation where any entrant(s) is/are found to be abusing or tampering with the operation of the Draw or entering using fraudulent means, or whom The Real Mary King's Close believes to have acted in breach of these terms and conditions, or in respect of Entrant(s) who do not give correct contact details or those who make an entry on someone else's behalf.

28. Any personal information collected by The Real Mary King's Close in connection with the Draw will be used in accordance with The Real Mary King's Close Privacy Policy (https://www.realmarykingsclose.com/privacy-policy/) and Crowdfunder's privacy and data protection processes. Entrants' personal data will only be used for the administration of the Draw and for contacting winners, unless the entrant has explicitly opted in (via the Crowdfunder platform or otherwise) to receive marketing communications from the Promoter. The Promoter will not use entrants' personal data for marketing purposes unless such consent has been given.

29. A list of winners can be obtained by sending a stamped addressed envelope to The Real Mary King's Close, 2 Warriston's Close, High Street, Edinburgh, EH1 1PG, together with the details of the prize draw winners list you require, within thirty (30) days from the Closing Date.

30. In accordance with applicable consumer protection and advertising regulations, The Real Mary King's Close is required to make available certain information to demonstrate that a valid prize award has taken place. To comply with this legal obligation, The Real Mary King's Close will provide the surname and county of major prize winners to any person who submits a written request within thirty (30) days of the Closing Date stated in Clause 11. The lawful basis for this processing is Article 6(1)(c) UK GDPR (compliance with a legal obligation). Where applicable, processing may also be carried out under Article 6(1)(f) UK GDPR (legitimate interests), namely promoting transparency in prize competitions. If you object to your surname and county being made available, you may contact us at datarequests@continuumattractions.com before the end of the thirty (30) day period. We will consider your objection in accordance with applicable data protection law. Please note, however, that where disclosure is required to comply with a legal obligation, we may still be required to share limited winner information. The Real Mary King's Close may also be required to provide winner information and winning entries to regulatory authorities, including the Advertising Standards Authority, where legally required to do so. 31. Nothing in these Terms and Conditions excludes or limits the Promoter's liability for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability which cannot be excluded or limited by law. Subject to this, the Promoter will not be liable for any loss, damage, injury or disappointment suffered by any entrant as a result of entering the Draw or accepting any Prize, save where such loss arises from the Promoter's breach of these Terms and Conditions or negligence. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, online computer systems, servers, providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the internet or at any website.

32. The Real Mary King's Close and their respective current and future parents, affiliates, subsidiaries, advertising and promotion agencies, licensees, successors and assigns and all of their respective officers, directors, agents and employees (collectively, "Released Parties") are not responsible for entries that are lost, late, incomplete, inaccessible / blocked, corrupted, misdirected, delayed or damaged, regardless of cause, all of which are void.

33. By participating in the Draw and/or accepting a Prize, entrant(s) agree(s) to hold The Real Mary King's Close and the Released Parties harmless against any and all claims and liability arising out of participation in this Draw or use/misuse of any Prize. Entrant(s) assume all liability for any injury or damage caused or claimed to be caused by participation in this Draw or use or redemption of any Prize.

34. The Real Mary King's Close's failure to enforce any provision of these Terms and Conditions in a given instance shall not constitute the waiver of such provisions.

35. Winner(s) name, likeness and social media username may be posted on the social media profile of The Real Mary King's Close after winner(s) has been selected, but there is no obligation for The Real Mary King's Close to do so.

36. In the event of any dispute regarding these Terms and Conditions, conduct, results and all other matters relating to the Draw, the decision of The Real Mary King's Close shall be final, subject to compliance with applicable law. No correspondence or discussion shall be entered into.

37. Draw may be cancelled, modified, terminated or suspended in the event of any computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes outside the control of The Real Mary King's Close which impairs or affects the administration, security, fairness, integrity, or proper conduct of the Draw. The Real Mary King's Close reserves the right at its sole discretion to disqualify any entrant(s) who tamper(s) with any entry or has harassed any The Real Mary King's Close representative or any other entrant(s) and to cancel, modify, terminate or suspend the Draw.

38. In the event of termination, a notice will be posted on this Crowdfunder page and/or on The Real Mary King's Close's Facebook page (https://www.facebook.com/realmarykingsclose) and winner(s) may be determined from entries received prior to cancellation based on the same criteria listed above.

39. These Terms and Conditions are governed by the laws of England and Wales. Entrants resident in Scotland shall retain the benefit of any mandatory consumer protections available to them under Scottish law. Any disputes shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
